How this is calculated

Maryland's Family and Medical Leave Insurance program (FAMLI) was created by the Time to Care Act of 2022 and is now Title 8.3 of the Labor and Employment Article. Later laws moved its start; the current dates come from HB 102 of 2025 (Chapter 363). Contributions are due on wages paid from January 1, 2027. Benefits begin in January 2028.

Contributions in 2027

  • The total rate for 2027 is 0.9% of wages, set by the Maryland Department of Labor and confirmed in April 2026. It applies to wages paid from January 1 to December 31, 2027. By law the rate can never be more than 1.2%; from 2027 the department announces each next year's rate by November 1.
  • Your employer may take up to half, 0.45%, out of your pay. Employers with 15 or more employees pay the other 0.45% themselves.
  • Employers with fewer than 15 employees only owe the employee half and may withhold it from pay. They count everyone on the same federal EIN, inside and outside Maryland, each quarter in 2027 and as a four-quarter average from 2028.
  • Contributions stop at the Social Security wage base, $192,300 for 2027, counted separately for each job. The most an employee pays in 2027 is $865.35.
  • Everyone working in a position located in Maryland takes part, including part-time and seasonal workers. Nobody can opt out, and contributions are not refunded. Federal employees are not covered. Self-employed people are not required to pay and can opt in later.

Example: a salary of $60,000 paid every two weeks is $2,307.69 per paycheck. 0.45% of that is $10.38, or $270 for the year. An employer with 15 or more employees adds another $270. Employers send both halves to the state every quarter; the first payment, for January to March 2027, is due April 30, 2027.

Benefits from 2028

You qualify after 680 hours of work in Maryland over the last four completed quarters. Leave lasts up to 12 weeks in a benefit year (up to 24 in some cases, such as a new child and your own serious illness in the same year). The weekly benefit follows a formula in the law (§ 8.3-703):

  • Average weekly wage = pay in your best of the last four completed quarters ÷ 13, figured for each employer.
  • 90% of that wage up to 65% of the state average weekly wage, plus 50% of the part above it. With the latest published state average of $1,537 (for 2026), the line falls at $999.05.
  • At least $50 and at most $1,000 a week through December 31, 2028. From 2029 the maximum rises with Washington-area inflation.

Example from the Maryland Department of Labor: $15 an hour for 40 hours is $600 a week, and 90% of that is a $540 benefit. With the 2026 state average, weekly pay of about $1,201 or more reaches the $1,000 maximum.

Limits of this estimate

The benefit uses the state average weekly wage for 2026. The one for 2028 is calculated in December 2027, and the benefit is figured with the figure in effect when your leave begins. The calculator turns yearly pay into a weekly wage by dividing by 52, which matches the law when every quarter pays the same. Employers with an approved private plan may set their own rate, but may not charge employees more than the state plan.

With wages paid on or after January 1, 2027. Employers send the first quarterly payment by April 30, 2027. Benefits start in January 2028.

How much is the Maryland FAMLI deduction?

The 2027 rate is 0.9% of wages, and your employer can take up to half, 0.45%, from your pay. On $60,000 a year that is $270, or $10.38 per biweekly paycheck. The most anyone pays in 2027 is $865.35, on wages up to $192,300.

Do small businesses have to pay Maryland FAMLI?

Employers with fewer than 15 employees still register, report each quarter and send the employee half, which they may withhold from pay. They do not owe the employer half. A sole owner who is the business's only employee is not an employer under the law.

How much will Maryland paid family leave pay?

90% of your average weekly wage up to 65% of the state average weekly wage, plus 50% above that, with a maximum of $1,000 a week through 2028. At $600 a week the benefit is $540. Leave lasts up to 12 weeks in a benefit year.

I live in Maryland but work in another state. Do I pay FAMLI?

No. FAMLI follows where the work is done. Someone who works in Maryland pays even when living in another state, and a Marylander working full time in another state does not.
